Thinking of dropping the Yamaha DS1 sound driver

The Yamaha DS1 was apparently a PCI sound card sold in the years 1997-2000;
its audio chipset was also present on pentium-II mainboards.

The DS1 sound driver includes a firmware file with a weird licence, ds1-fw.h:
http://gitweb.dragonflybsd.org/dragonfly.git/blob/HEAD:/sys/dev/sound/pci/ds1-fw.h

The issue is in section 3:
"3. This file may not be used in a commercial product not based on FreeBSD."

This is extremely restrictive compared to other licenses we have in tree.

Given the old age of this hardware, dropping the driver may be the best
solution to resolve the license issue.

Are there users of this card/chipset on this list ?
Please speak-up if this is the case.
