:much needs to be changes for something to legally be considered to be a
:derivative work or how it is measured but I would guess that it is
:measured more in functionality than in amount of code.

    It gets even worse, because as you all know most modifications made
    to source code are incremental in nature.  One of these commits might
    not pass the test, but several taken together probably would.  If
    you look at the source file over a longer period of time, say a few
    years, it can wind up being a completely different entity than the
    original was.  Now what do you do?
